不应简单认为没有责任。泰国劳动法和实务中会关注谁实际管理工作、谁安排工时、谁提供场所、谁进行考核以及谁从劳动成果中受益。即使员工名义上由第三方雇佣,实际用工企业仍可能在工资福利、工作条件、安全管理或争议处理中承担相应责任。建议在协议和实际管理中保持一致。

不宜简单处理。泰国劳动关系中,试用期并不意味着雇主可以忽视通知、证据和程序要求。解除前通常需要结合劳动合同、考核记录、工作表现、警告记录和实际在职时间判断。对于重要岗位或争议风险较高的员工,建议先进行文件审查和证据整理,再决定解除或协商路径。

外籍员工还涉及签证、工作证、工作地点、岗位、雇主信息、税务和社保资料的一致性问题。若实际工作安排与证照文件不匹配,可能影响用工和移民合规。对于跨府项目、工厂现场或工程现场,应提前评估工作地点、项目合同和岗位说明是否需要同步调整。

企业应先固定事实和证据,包括劳动合同、员工手册、考勤、工资、社保、绩效、警告信、沟通记录、离职文件和现场资料。随后评估是否适合协商、调解、补偿、纪律处分或诉讼应对。不要在事实不清或文件不足时仓促发出解除通知,以免扩大后续劳动争议风险。
